Agreement

By using this website you agree to these terms. If you do not agree, please do not use the site. Client engagements are governed by a separate written service agreement, which controls if it conflicts with anything here.

What this site is

This site describes services offered by Inspirit Media & Marketing LLC. Content is general business information and is not legal, tax, accounting, financial, or professional advice. Pricing shown is a starting point and may change. Nothing on this site is an offer that can be accepted to form a contract, and no engagement begins until a written agreement is signed.

Services and scope

Deliverable volumes listed on this site, including numbers of posts, designs, videos, and pages, reset monthly, do not roll over unless agreed in writing, and are produced to the brand standards agreed at onboarding. Turnaround times depend on receiving materials, approvals, and access from the client. Advertising budgets are paid by the client directly to the advertising platforms and are separate from service fees.

Client responsibilities

Clients are responsible for the accuracy and legality of the material they provide, for holding the rights to any logos, photos, footage, or text supplied to us, for maintaining required licenses and insurance for their own business, and for the truthfulness of claims made about their own products and services in approved marketing.

Ownership

The site, its design, text, and graphics are owned by Inspirit Media & Marketing LLC. Final approved deliverables produced for a client transfer to that client on full payment as set out in the service agreement. Underlying tools, systems, templates, and processes remain ours.

Third party platforms

Our services depend on platforms we do not control, including search engines, social networks, and advertising systems. Those platforms set their own rules, pricing, and algorithms and may change them without notice. We are not responsible for outcomes caused by those changes, account suspensions, or platform outages.

Billing

Monthly services are billed in advance and continue until cancelled in accordance with the service agreement. Fees paid are for work performed and are non refundable except where required by law or expressly stated in the agreement.

Limitation of liability

To the fullest extent permitted by law, Inspirit Media & Marketing LLC is not liable for indirect, incidental, consequential, or lost profit damages. Our total liability for any claim is limited to the fees you paid us in the three months before the event giving rise to the claim. The site is provided as is without warranties of any kind.

Governing law

These terms are governed by the laws of the State of California. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Stanislaus County, California.

Age restriction

Our website, services, and SMS program are intended only for individuals who are 18 years of age or older. By using this site, opting in to SMS, or engaging our services, you represent that you are at least 18. We do not knowingly collect information from anyone under 18. If we learn that we have received information from someone under 18, we will delete it.

SMS program

If you opt in via our website forms, Inspirit Media & Marketing LLC may send mixed informational and promotional texts about Discovery Calls, weekly strategy sessions (Wednesdays 12:00 PM PT), AI Marketing Assessment follow-ups, and related booking links. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Reply STOP to opt out anytime. Reply HELP for help or call (619) 639-3509. Consent is not a condition of purchase.

SMS opt-in consent is not sold or shared with third parties for their marketing. We only share it with our SMS and CRM providers as needed to deliver the messages you requested. See our Privacy Policy for more detail.
